2. Scope
These Terms of Use and General Terms and Conditions apply to the use of this website and to all orders placed by customers through the reformé online shop.
Any terms and conditions of the customer that deviate from these terms shall apply only if we expressly agree to their application in writing.
Orders placed or support provided through third party platforms, particularly crowdfunding platforms such as Kickstarter, are also or primarily subject to the terms specified for the relevant platform and campaign.
3. Products and Intended Use
reformé develops and sells sports equipment, particularly football shin guards.
The reformé Shield is a shin guard intended for use in association football. It is designed to be worn under a football sock and to be fitted before first use in accordance with the enclosed instructions.
The reformé Shield is not a medical device or an orthopaedic aid, and is not intended for other protective applications such as motorsport, combat sports, ice hockey, occupational safety or comparable high risk applications.
Shin guards can reduce the risk of injury but cannot guarantee complete protection against injury. Football remains a contact sport.
4. Fitting and Use
The reformé Shield is supplied flat and is fitted to the shin before first use by heating and shaping it. It may be fitted only in accordance with the enclosed instructions and the guidance provided on our website.
Before heating and fitting the product, the customer must check that the size supplied is correct and that the product has no visible damage. If the size is incorrect, the product has visible damage, or there is any uncertainty, the product must not be heated or fitted. In this case, our support team must be contacted before the product is used.
Heat forming should be carried out carefully, in a controlled manner and only by a suitable person. Products for underage users must be fitted by an adult or under adult supervision.
Improper fitting, particularly through excessive temperatures, exposure to a direct flame, sharp folding, concentrated excessive pressure, unsuitable tools or failure to follow the instructions, may damage the product.
5. Formation of the Contract
The display of products in the online shop does not constitute a legally binding offer. It constitutes an invitation to place an order.
By clicking the order button, the customer submits a binding offer to purchase the products contained in the shopping basket.
Once the order has been received, the customer receives an automatic order confirmation by email. This confirmation records receipt of the order. The purchase contract is formed when we expressly accept the order, dispatch the goods or finally confirm payment.
We reserve the right to reject orders, particularly where products are unavailable, payment details appear implausible, misuse is suspected, or personalisation cannot be implemented for legal, technical or content related reasons.
6. Prices, Shipping Costs and Payment
All prices stated in the online shop are in euros and include statutory value added tax where applicable.
Shipping costs may be charged in addition. Shipping costs are displayed during checkout before the order is completed.
The available payment methods are displayed during checkout. Payments may be processed by external payment service providers. The terms of the relevant payment service provider may also apply to its services.
7. Delivery
Delivery is made to the delivery address entered during checkout.
Available destination countries, shipping methods and estimated delivery times are displayed in the online shop or during checkout. Delivery may be delayed if products are temporarily unavailable, address details are incorrect, or shipping providers experience delays.
For consumers, the risk of accidental loss of or accidental damage to the goods passes to the customer only when the goods are handed over to the customer.
8. Retention of Title
The goods remain our property until payment has been made in full.
9. Right of Withdrawal and Returns
Consumers generally have a statutory right of withdrawal. Details are set out in our separate withdrawal policy.
The statutory right of withdrawal may be excluded for goods made to customer specifications or clearly tailored to personal requirements. This applies particularly to individually personalised products once they have been manufactured in accordance with the customer specifications.
The statutory right of withdrawal generally remains available for products that are not personalised. However, if a product is heated, fitted, worn or used in a manner that goes beyond what is necessary to establish its nature, characteristics and functioning, this may result in a loss of value. In this case, the customer may be required to compensate us for that loss in value.
We therefore expressly ask customers to check the size, condition and contents of the delivery carefully before heating, fitting or wearing the product.
Statutory rights in respect of defective products remain unaffected.
10. Returns Process
Customers should contact our support team before returning a product so that we can correctly allocate the return and explain the next steps.
The exercise of a statutory right of withdrawal is not conditional upon obtaining prior return authorisation. However, contacting us in advance helps to prevent errors in the return, allocation or refund process.
Products should be packaged securely for return wherever possible. If returned goods are damaged, used, fitted or incomplete, we reserve the right to claim compensation for loss of value to the extent permitted by law.
11. Statutory Rights in Respect of Defects
Statutory rights in respect of defects apply.
Customers are asked to inspect delivered products upon receipt for obvious shipping damage, an incorrect size, an incorrect delivery or visible material defects, and to notify us of any such issue as soon as reasonably possible.
This request does not restrict the customer’s statutory rights.
Damage caused by improper fitting, unsuitable heating, use for an unintended purpose, excessive mechanical stress, modification of the product or failure to follow the instructions does not constitute a product defect, unless the damage is attributable to a defect that was already present when the product was handed over.
12. Personalised Products
Where personalised products are offered, the customer is responsible for ensuring that any names, text, logos, numbers, graphics or other content supplied may be used lawfully.
We reserve the right to reject personalisation, particularly where content is unlawful, offensive, discriminatory, infringes trade mark rights or copyright, or cannot be implemented technically.
Personalised products may be excluded from the right of withdrawal once they have been manufactured to customer specifications. Statutory rights in respect of defects remain unaffected.
13. Product Images and Variations
Product images on the website are intended to illustrate the product. Minor variations in colour, surface texture, manufacturing details or packaging may occur, provided they are reasonable for the customer and do not impair the function of the product.
Additively manufactured products may exhibit minor traces characteristic of the manufacturing process. These do not constitute a defect as long as the protective function, fit, safety and intended use are not impaired.
14. Vouchers, Discount Codes and Promotions
Vouchers, discount codes and promotional offers apply only subject to the terms stated for the relevant offer.
Discount codes may be limited in time or quantity, apply only to particular products, or be restricted to certain countries. They may be applied retrospectively to completed orders only where we expressly offer this option.
15. Website Content
All content on this website, particularly text, images, videos, graphics, product designs, logos, trade marks, instructions and other materials, is protected by copyright, trade mark law or other applicable rights.
Use, reproduction, modification, distribution or public presentation is not permitted without our prior consent, unless permitted by law.
16. Feedback, Reviews and Communications
If customers or testers send us feedback, reviews, photographs, videos or other comments, we may use this material internally for product improvement, quality assurance and further development.
Names, images, quotations, videos or personal statements will be used publicly only with the separate consent of the person concerned.
17. Availability of the Website
We endeavour to keep the website and online shop reliably available. However, we cannot guarantee uninterrupted availability at all times.
We reserve the right to change, expand, restrict or temporarily disable the website, individual functions, content or product offerings at any time where this is necessary for maintenance, security, technical development or operational reasons.
18. Liability
We have unlimited liability in cases of intent and gross negligence, and for injury to life, limb or health.
In the event of a slightly negligent breach of a material contractual obligation, our liability is limited to the loss that is typical for the contract and was foreseeable. Material contractual obligations are obligations whose performance is essential to the proper fulfilment of the contract and on whose fulfilment the customer may generally rely.
Liability under the German Product Liability Act and any other mandatory statutory liability remain unaffected.
19. Force Majeure
If events beyond our reasonable control prevent us from performing contractual obligations, the relevant performance periods shall be extended by a reasonable period. Such events may include natural events, war, strikes, official measures, power outages, supply chain disruptions, failures by shipping providers or significant technical disruptions.
The customer’s statutory rights remain unaffected.
20. Governing Law
German law applies, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods.
For consumers, this choice of law applies only to the extent that it does not restrict mandatory consumer protection provisions of the country in which the consumer has their habitual residence.
21. Place of Jurisdiction
The statutory places of jurisdiction apply to consumers.
If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is our registered place of business.
22. Consumer Dispute Resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

23. Amendments to These Terms

24. Severability
If any provision of these terms is or becomes invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the applicable statutory provisions.
